How to Get a Cannabis Business License in Arizona | Arizona Cultivation License and Marijuana Laws

Arizona voted to legalize marijuana when it passed Prop 207 by 60 to 40% of the vote in 2020. Arizona takes effect once the election results are made official Nov. 30. The Department of Health Services must adopt rules to set the number of licenses coming – but not more than one for every 10 pharmacies operating within the state.

The Arizona Department of Health Services (“ADHS”) will grant approximately 150 marijuana establishment licenses. Of these licenses, 26 will be specifically allocated to applicants who qualify under the Social Equity Ownership Program.
Define Early Applicant = Entity seeking to operate a marijuana establishment in a county with less than two registered nonprofit medical marijuana dispensaries, or a non-profit medical marijuana dispensary registered and in good standing with the department that wishes to obtain an establishment license.

Define Social Equity = increasing the license numbers up to 10 % in furtherance of social equity programs created by Department of Health Services. They are going to study it. Section 36-2854 provides for some nebulous concepts.

Marijuana Establishment = single retail location to sell marijauna products to customers & a signal off-site cultivation location & a single off-site location to manufacture marijuana products. (Mandatory vertical license).

Define license numbers and timeslot = Only two Marijuana Establishment License per county will be issued, as long as it does not contain a non profit medical marijuana dispensary, if it contains one registered non profit medical marijuana dispensary, it will only issue one. The early applications will be accepted from January 19th, 2021 to March 9th, 2021, after issuing the license to the early applicants the department will issue establishment licenses by random selection

Types of licenses available:
The Marijuana establishment license: authorizes to have a single retail location to sell, a single off site location to cultivate, process and produce and a single off site location to manufacture and package marijuana, the last two are not authorized to sell Marijuana in any manufacturing or cultivating location.
The Marijuana testing facilities license: authorizes the analysis and monitoring of the potency of the product and testing for any harmful contaminant in the marijuana.
Delivery after 2023? – ADHS may adopt rules that allow for it.

Home grow?
YES, 6 plants, Max 12 for homes with 2 or more adults

Social Equity?
Bare Minimum Criteria Towards Restorative Justice:
Expungement? YES
Social Equity Provisions? YES
Portion of Taxes Allocated to Impacted Communities? YES

26 licenses will be issued to entities under the Social Equity Ownership Program
10% of taxes will be allocated to the Justice Reinvestment Fund (JRF)

Possession Rules
1 ounce flower or 5 grams concentrate

    We a republican state…this is test run ….we as Arizonans are making sure all the i’s & lower J’s have been dotted..i think we goin see more fair market without foreign product infliencey as well as, or state to state big company monopolization .it protects small man allowing more free entrepreneurship then in A couple years of establishment of Arizona data; we Make better focused legislation…remember we conservative state still; i believe…so we looking where to go? ..but we need Arizona data…thats why they look to medical and alcohol data…only think we got which is medica data….i think we as Arizonans want think of it as medical 1st recreational 2nd….not other way around as most states do…….Its mary jane red..not mary jane blue state……lol

    read somewhere that medical caregivers can sell excess product to dispensaries as many dispensaries were limited to one grow location that might not fit their needs and that many dispensaries are not expected to have their own grow components at all and need to acquire supply. is there any truth to this? ive seen other articles that look to both confirm and deny this kind of thing but the language is very abstract in both cases and the quest for an answer has been keeping me up at night lol.

    You said AZ can have 6 plants. Question I have is there a size to a plant.
    2nd it’s a 1 oz possession of bud. Is that for transport or possession at home say you grow six plants if they’re produce more than an ounce is that illegal?

    Yes, they are giving the current operations another license (practically automatic) for recreational and they are randomizing 51 other licenses towards normal citizens particularly with people who have been affected & stigmatized by marijua by March 2021. Buttt they have good home crop laws coming in for people who would want to Grow on their on property.

    Great talk… They took this law based on the alcohol laws and just added Marijuana to it and reprinted it. We went through this same shit with a brewery license 10 years ago. It is a large Moron influence for most of the Phoenix Metro, which controls the state.

    I NEVER thought I’d live to see the day when AZ would LEGALIZE recreational marijuana. The state voted for Biden ( who’s basically a republican himself n we all know it) but make no mistake about it this is A DEEP DEEEEEEEP RED state. The Republican establishment in this state HATES this new law, I mean AZ was the only state in the union where they still handed out FELONIES for a 20 bag/grams worth of herb. Insane. Doug Ducey contemplated trying to fight this new bill even though it passed with 60% of the vote or 3 of 5 voters voting yes.
