New cannabis protection law ignites in California with new year

A new law will prevent California employers from punishing employees for recreational use outside of work hours starting January 1. While current and prospective workers can still be tested, they cannot be disciplined unless they are high at the time of the test.

For years, people would take a drug test and they could fail if they had ingested marijuana within 2-6 weeks of taking a test. But a new law protects workers if they use marijuana recreationally, and it shows up on a test.

VP of Human Resources for Optima Health Jilian Dimitt believes the new law helps employers.

“The new law just reinforces that employees who are using marijuana for recreational use, are going to be allowed to continue to do that. They don’t have to worry about it,” she said. “What Newsom did was make sure employers could not prohibit them from doing it. They could not take any adverse action against them. The key thing is, you can’t come into work under the influence or bring it into the workplace and obviously you can’t smoke pot in the workplace.”

She says the new testing will be key. It’ll need to show active traces of THC that actually cause impairment to a person’s ability to do their job for a worker to be punished or for a candidate to not be hired.

“So many people are smoking pot so they’ll still be able to get good workers, they’ll just be able to get good workers who aren’t coming to work under the influence,” Dimitt said.

But nationally-recognized cannabis lifestyle reporter Jackie Bryant who is based in San Diego believes the new law is not practical or feasible. She says drug testing technology does not actually exist that can assess whether a person is intoxicated by THC at that exact moment or not or how long it has been since it was ingested.

“Knowing that there’s no definitive science knowing when someone is acutely intoxicated from cannabis, there’s not a scientific test,” Bryant said. “That’s an obvious court case. It’s a legal quagmire. Why would you want to get into that for weed? Something that isn’t even heavily intoxicating.”

    Got fired after a positive test at BootBarn distribution, even though I LITERALLY spoke face to face with my supervisor before hand, telling him I use it and even have a medical rec. and he said “oh your ok, don’t worry”

    ..I’m then fired automatically, after my positive goes through to corporate.. so, make a call to the lawyer, get my copies of my recommendation and some published medical studies on cannabis remaining in the system for extended periods without being metabolized.. all attached together on a forward email from my lawyers “letterhead” along with my very carefully worded and completely legal “threat” basically lol I cited multiple instances of inconsistency with the drug policy that are on record and pretty much said if you shit-can a cannabis patient with Crohn’s who told you before testing that he’s using it medically that BootBarn will face the force of both the legal system and the public eye taking a major PR hit when I blast it all over the internet

    I was politely invited to come back and resume my job unloading trucks as the lead fork driver for receiving. I smiled a smug victorious grin as I walked in again seeing my supervisor and The manager clearly disgusted to be bested by a stoner.. serves them right, I worked like a machine for them, often lending a hand to other departments when I was already ahead in my own department, cleaned and organized random areas, tons of extra shit nobody ever asked me to do, because u was ahead of schedule and I don’t like to just stand around. But yeah lazy stoner stereotype huh..

    Became their official cannabis policy after that.

    Ended up suing and winning anyways when they went full-dictator for covid, both me and my wife, had a drunk fork driver almost drive a pallet into my pregnant wife who worked nearby, after we repeatedly told them about his performance and drinking on the job, and they had me doing 14 hour days 6 days a week and started threatening to fire me or rather strongly implying “I’d have no job suddenly” 🙄 if I didn’t start skipping by 15 min breaks and even taking half my lunch.. and the clock in and out times just kept stretching a little earlier each morning and like twenty to thirty min after you “clock out” at night you’d be there just “helping” they called it.. yeah helping unload one more 53’ truck while the manager watches me standing there doing nothing. They started standing at the end of the trucks making sure guys didn’t take a breather for more than like 2 min.. so they got another letter.. and they didn’t listen.. so they graciously gave us a settlement after my manager specifically said, directly to my wife’s face, that “if we sue them, which I know you won’t,” he said, “you’ll loose hahaha!” Laughing in her face.
    Made sure to list the date time and witnesses present to his wrongful activities including showing employees memes on his personal cell phone with a big black cock hanging out and calling homosexual employees “fag” so i specifically included a line that said “BootBarns defense of this managers actions would be condoning hate speech and sexual harassment, that anything other than reprimanding him immediately with the same severity as any other employee regardless of position and title would again be condoning these actions.”

    We got two settlement checks and a call from our lawyer saying he’s going to be investigated based on the claims we made but the dates times and other employees present that I listed makes it really easy to get witness accounts and subpoena his cell records for the illicit stuff he was sharing with other managers and showing to us employees. Lawyer said I pretty much handed BB’s legal team all they need to ruin this guy. Who TF’s laughing now
