Former LIRR employees challenge marijuana policies

Marijuana may be legal in New York, but if you work for the LIRR, you could still lose your job if you test positive. Now, two former employees have been filed suit over their firings over marijuana use. FOX 5 NY’s Jessica Formoso has the story.

    The reporter is wrong when she says "Employers are no longer required to test for Marijuana"
    Employers were never required in the first place. Employers chose to test for narcotics which includes Marijuana. Employers still have the freedom to require a test.

    The lawyer is also wrong. Employers requiring employees to take a drug test does not violate state law. State law only legalizes recreational use. This does not include on the work place or what employers require of their employees. Also, there is no Federal law that address employment rights for narcotic users or employers hiring narcotic users.
    If the MTA already had a written policy with regards to narcotics use then the former employees have no case.

    I use cannabis but I can’t say i’d be cool with a signalman or train engineer being as high as I am on the same train ☠️😂

    Safety sensitive , same with alcohol, it’s legal but it will impair thinking and motor skills. Would you want a doctor to operate on you while high? Ok now get back to work k.c. Jones

    I mean also 25 years on the job, coming off medical leave and coming back at this point you know youre going to get tested lol why take the risk?

    If they are really about zero toloernce and safety they’d be testing for alcohol and doing daily sobriety tests.

    What y’all don’t realize is a lot of these workers drink and do worse drugs than weed. I get the zero tolerance WHILE ON THE JOB, but they can definitely change the rule similar to what airlines do..no substances 8-10 hours before work.
